§ 01

Agreement to Terms

These Terms of Service ("Terms") govern your use of lafgallery.com, emptywallstudios.com, and any services, content, or products offered by Empty Wall Studios, a Florida registered fictitious name operated by Hunter James LaFever (collectively, "we," "us," "our," or "Empty Wall Studios"). By accessing or using this website, requesting information, or purchasing artwork, you ("you" or "Buyer") agree to be bound by these Terms.

If you do not agree with these Terms, please do not use this site or purchase from Empty Wall Studios.

§ 02

About Empty Wall Studios

Empty Wall Studios is the fine art practice of Hunter James LaFever, a South Florida painter and the originator of Abstract Guided Camouflage (A.G.C.), a named and documented painting methodology.

All works offered through this site are original acrylic paintings created by the artist. Empty Wall Studios is a sole proprietorship registered in Florida under Fictitious Name Registration No. G26000059033 (filed April 23, 2026, valid through December 31, 2031).

Use of the Site

This website is provided for the personal viewing and information of visitors and the facilitation of sales and inquiries for original artwork by Hunter James LaFever.

You agree not to:

  • Copy, reproduce, republish, scrape, or redistribute any content from this site without express written permission
  • Use any images of artwork, text, or design elements from this site for commercial purposes
  • Attempt to gain unauthorized access to any part of the site
  • Use the site for any illegal or unauthorized purpose
  • Interfere with the security or functionality of the site
  • Misrepresent yourself or your affiliation when contacting Empty Wall Studios
§ 04

Intellectual Property

4.1 Ownership

All content on this site — including but not limited to photographs of artwork, artwork titles, written descriptions, the Abstract Guided Camouflage methodology, site design, and all related documentation — is the intellectual property of Hunter James LaFever and/or Empty Wall Studios. All rights are reserved.

4.2 Abstract Guided Camouflage (A.G.C.)

Abstract Guided Camouflage (A.G.C.) is a named painting methodology originated, developed, and documented by Hunter James LaFever. The term, the methodology, the Four-Rotation Method, and the Five Pillars framework are protected intellectual property. Unauthorized reproduction, imitation, commercial use, or rebranding of this technique or its documentation is strictly prohibited.

4.3 Artwork Ownership After Sale

When a Buyer purchases an original work from Empty Wall Studios, the Buyer acquires physical ownership of the artwork. The copyright, reproduction rights, and all intellectual property rights remain with the artist.

Buyers may NOT

  • Reproduce, print, or create derivative works from the purchased art
  • Use images of the purchased art for commercial purposes
  • Display images of the purchased art in any for-profit promotional context without express written permission

Buyers MAY

  • Display the physical artwork in their home, office, or private space
  • Photograph the artwork for personal use
  • Loan the artwork to museums or institutions for non-commercial exhibition with artist notification
  • Resell the physical artwork (the original copyright remains with the artist)
§ 05

Purchases & Payment

5.1 Purchase Process

All purchases of original artwork are initiated through direct inquiry via email, phone, or the site's Purchase Inquiry form. No purchases are processed instantly through the site. Each sale is a personal transaction between the Buyer and the artist, subject to:

  • Confirmation of availability (works may be listed but not yet sold, or held for other serious inquiries)
  • Price agreement (prices listed or shared privately reflect asking price — the artist reserves the right to adjust pricing at any time)
  • Payment in full before shipment
  • Acceptance of these Terms and the Return Policy

5.2 Pricing

Prices for original works are listed on the private price list, provided upon request. Prices reflect asking price for the original work only and do not include:

  • Shipping and insurance (calculated at time of purchase)
  • Applicable sales tax
  • Import duties, customs fees, or taxes (for international buyers)

Prices are shown in US Dollars (USD) and are subject to change without notice until a purchase agreement is confirmed.

5.3 Payment Tiers

Accepted payment methods are tiered by purchase amount:

All payments must be received and confirmed cleared before artwork ships. Wire transfers must originate from the buyer's personal or business account — no third-party wires accepted.

5.4 Cryptocurrency Payments

Empty Wall Studios accepts cryptocurrency payments via Coinbase Commerce, which provides industry-standard compliance screening on every transaction before funds are released to the studio.

  • Bitcoin (BTC)
  • USDC (stablecoin)

Payment Terms

  • USD sale price is locked at time of purchase confirmation
  • Buyer has one (1) hour to complete the Coinbase Commerce transaction at the locked USD amount
  • Artwork ships only after Coinbase Commerce confirms the payment as cleared
  • All crypto payments and refunds are subject to the terms, policies, and technical requirements of Coinbase Commerce

Not Accepted

  • Privacy coins (Monero, shielded Zcash, Dash)
  • Payments from mixers, tumblers, or sanctioned wallets (auto-rejected by Coinbase Commerce screening)
  • Direct wallet transfers outside the Coinbase Commerce flow
  • Payments from PulseChain or other networks not supported by Coinbase Commerce
Future plans — Digital Authentication: Empty Wall Studios plans to introduce on-chain Certificate of Authenticity tokens (NFTs) on the Base network as an optional additional authentication layer for crypto-native collectors. Details and timing will be announced separately when deployed.

5.5 Certificate of Authenticity — Release Schedule

Every sale receives both a physical and a digital Certificate of Authenticity. Release timing is tied to the chargeback or reversal window of the payment method used:

Both the digital and physical Certificates of Authenticity are mailed together at the release date. The painting itself ships upon payment clearance; the Certificates follow on the schedule above.

This practice aligns documentation release with the finalization of payment risk, protecting both buyer and artist.

5.6 Failed or Disputed Payments

If a payment is disputed, charged back, or reversed after the artwork has shipped, the Buyer remains liable for the full purchase price plus any costs incurred by Empty Wall Studios in recovering payment or the artwork.

§ 06

Commissions

Empty Wall Studios accepts commissioned works on a limited basis. Commissions are subject to a separate agreement that will include:

  • Scope, size, medium, and subject parameters
  • Timeline and milestones (typical range: 6 to 12 months, varying by size and complexity)
  • Pricing (50% non-refundable deposit at commission agreement, 50% balance due before shipment)
  • Artist's creative authority over final execution (Buyer may provide direction, but final aesthetic decisions rest with the artist)

Commissioned works are non-returnable and non-refundable upon delivery, except in cases of shipping damage (see Return Policy).

The artist reserves the right to decline any commission request for any reason.

§ 07

Availability of Works

Original artworks are one-of-one. A listing on the site does not guarantee availability — works may have been sold, withdrawn from the market, or placed on hold. All purchase inquiries are confirmed on a case-by-case basis.

Works marked "Not For Sale" (NFS) are permanently retained by the artist and are not available for purchase.

§ 08

Shipping

Detailed shipping terms are set forth in the separate Shipping Policy, incorporated into these Terms by reference.

Summary

  • Domestic (US) shipping is offered on all available works
  • International shipping is available on request, quoted separately
  • All international buyers are responsible for import duties, customs fees, VAT, and any other taxes imposed by the destination country
  • All shipments are fully insured; transit damage is addressed through insurance claims
  • Certificates of Authenticity follow a release schedule tied to payment method (see §5.5)
§ 09

Returns & Refunds

Detailed return terms are set forth in the separate Return Policy, incorporated into these Terms by reference.

Summary

  • All sales of original artwork are final. Original acrylic paintings are sold as unique, non-returnable items.
  • Shipping damage must be reported with photographs within 48 hours of delivery for insurance claims to be honored
  • Wrong-painting-shipped is the only non-damage return exception
  • Commissioned works are non-refundable upon delivery
  • Mandatory return of ALL original documentation (including the signed Certificate of Authenticity) is required before any refund is processed
§ 10

Authenticity & Provenance

Every original work sold by Empty Wall Studios is accompanied by:

  • A signed Certificate of Authenticity (physical and digital) identifying the title, dimensions, medium, year, and artist signature
  • Verification of origin traceable to the artist's studio in Boynton Beach, FL
  • Artist-retained documentation for provenance research, maintained in a permanent studio ledger

In the event of resale, a Buyer may request updated provenance documentation at no charge (within reasonable limits).

§ 11

Limitation of Liability

To the fullest extent permitted by Florida law:

  • Empty Wall Studios, Hunter James LaFever, and any affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from the use of this site, the purchase of artwork, or any related transactions
  • In no event shall the total liability of Empty Wall Studios for any claim related to a purchase exceed the total purchase price paid for the artwork in question
  • This site is provided "as is" without warranties of any kind, express or implied

Nothing in this section limits any rights you may have under applicable consumer protection laws that cannot legally be waived.

§ 12

Indemnification

You agree to indemnify, defend, and hold harmless Empty Wall Studios, Hunter James LaFever, and any affiliates from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your misuse of the site or purchased artwork
  • Any breach of these Terms by you
  • Any unauthorized reproduction, commercial use, or display of purchased artwork
  • Any third-party claims arising from your actions related to Empty Wall Studios' intellectual property
§ 13

Dispute Resolution

13.1 Informal Resolution

We value our relationships with collectors, clients, and visitors. If a dispute or concern arises, we ask that you contact us first at emptywallstudios@gmail.com to allow us an opportunity to resolve the matter directly. Most issues are resolved through direct conversation.

13.2 Binding Arbitration

If a dispute cannot be resolved informally within 30 days, both parties agree that any remaining dispute arising out of or relating to these Terms, any purchase, or any use of the site shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

  • Location: Palm Beach County, Florida (or by video conference by mutual agreement)
  • Governing Law: Florida state law
  • Individual Claims Only: Disputes must be brought in your individual capacity. Class actions, class arbitrations, or representative proceedings are not permitted.
  • Language: English

13.3 Small Claims

Notwithstanding the above, either party retains the right to bring an individual action in small claims court for disputes within that court's jurisdiction.

13.4 Waiver of Jury Trial

To the extent permitted by law, both parties waive any right to a trial by jury.

§ 14

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any judicial proceedings (to the extent permitted after arbitration) shall take place exclusively in the state or federal courts located in Palm Beach County, Florida.

§ 15

Changes to These Terms

Empty Wall Studios reserves the right to update or modify these Terms at any time. Changes take effect immediately upon posting on the site. Continued use of the site after changes constitutes acceptance of the revised Terms.

The "Last Updated" date at the top of this document reflects the most recent revision.

For material changes affecting existing purchase agreements, we will notify affected parties directly via email when reasonably possible.

§ 16

Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, and Return Policy (each incorporated by reference), constitute the entire agreement between you and Empty Wall Studios regarding use of the site and purchases of artwork. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
